For a limited company without BOI promotion, whether it is a Thai majority or Burmese owned company, there must be at least 2 million Baht fully paid-up capital and 4 Thai employees to support the work permit application for each expat, including the foreign directors of the company. This also applies to Burmese-Americans who set up the company under the Treaty of Amity.
Once you have hired employees, please make sure to register them with the Thai Social Security Office and submit their monthly Social Security contributions as well as their salary’s withholding tax returns with the Revenue Department because when you extend the visa at the Immigration Office, the company needs to show monthly employee’s salary withholding tax returns from the latest 3 months showing 4 Thai employees for each expat who has a work permit with the company at the time of visa extension.
For a Representative office or branch office, the minimum capital required for the head office to remit to its representative or branch office in Thailand is 3 million Baht which is already enough to support 1 work permit application. The representative office or branch office must be also hire at least 1 Thai staff per 1 work permit applicant.
For a limited company with BOI promotion, one of the non-tax incentives that Thailand BOI grants to promoted businesses include bringing in as many foreign skilled workers and experts as required. Because there is less restriction in terms of capital requirement and number of employees for BOI promoted companies, you do not need to hire 4 Thai employees to support 1 work permit application.
